Terms of Service
Last updated: October 11, 2026
These terms are the agreement between you and Whateverland AB, the Swedish company that makes Skape. We've tried to write them so you can read them in fifteen minutes. If something is unclear, ask us at hello@skap.es.
The short version
- Skape is for organizations and professionals who make location-based experiences. Listeners don't need an account.
- Building and testing is free. Paid publishing plans cost what the pricing page says, with monthly or yearly payment. Selected organizations can receive complimentary publishing access.
- What you make is yours. We only use it to run Skape for you.
- You're responsible for having the rights to what you publish, and for the places you send people.
- You can leave whenever you want and take your projects with you.
Who we are
Whateverland AB, reg. no. 559285-6099, VAT no. SE559285609901, Sturegatan 87, 791 60 Falun, Sweden. hello@skap.es.
Who Skape is for
Skape is made for organizations and professionals: museums, municipalities, regions, artists, producers and studios. When you create an account or order a plan, you do it for your work, or for an organization you're allowed to represent.
If you use Skape as a consumer, for yourself rather than for work, Swedish consumer law still protects you, and nothing in these terms takes those rights away. Paid plans are for organizations and businesses. If you're ordering for yourself, tell us before you order. We'll quote prices including VAT and explain your right to cancel within 14 days.
You need to be at least 16 to create an account.
Listeners open published projects in the Skape app without an account, and listening is free. For listeners, the parts about acceptable use, reports, liability and law apply. Projects are made by the people and organizations who publish them, not by us. When you listen, keep an eye on traffic and the ground in front of you, and keep the volume low enough to hear what's around you.
Your account
- Keep your password to yourself. You're responsible for what happens in your account. Tell us right away if you think someone else has access.
- One account per person. To work together, invite people to your team instead of sharing an account.
- Free accounts have no time limit, and we don't close accounts because they haven't been used.
Plans, prices and invoices
- Building, testing and previewing on your phone are free.
- Publishing capacity belongs to your team: Basic covers one live project, Pro up to ten, and Enterprise the capacity in your agreement. Monthly and yearly plans have the same capacity.
- A paid plan costs what the pricing page says when you order. Online payments and automatic renewal use Mollie. You can pay monthly or yearly in advance; invoice arrangements for Enterprise are agreed separately. Prices are in euros and don't include VAT. Your purchase summary shows applicable VAT and when the paid period starts and ends.
- A team owner can stop automatic renewal in Billing. Existing paid coverage remains until its end. Projects without current publishing coverage become unavailable to listeners; they stay in your account and can be published again later.
- We can grant selected organizations complimentary publishing capacity, with an expiry or until revoked. No payment or automatic renewal is required. When it ends, projects already covered by a retained paid plan remain available for their paid period; other projects need publishing coverage.
- If we change our prices, we tell you at least 60 days before the new price applies to you. We never change the price of a period you've already paid for.
Your content
- What you make is yours: audio, images, text, maps, recordings and logic.
- To run Skape, you let us store, copy, process and send your content: to your team while you work on it, and to listeners when you publish it. This permission lasts as long as the content is in Skape.
- We don't use your projects to market Skape without asking you first, and we don't train AI models on them. We look inside a project only when you ask us for help, when we need to fix a problem, when we handle a report about it, or when the law requires it.
- Unpublishing stops the project's code and link from working right away. A phone that already downloaded the project can still play it offline until the app next opens it with a connection, and the downloaded files stay on the phone until the listener deletes the app. Files that were published stay reachable at their exact web address until you delete the project.
- Deleting a project removes it and its files from Skape, including published files. Copies in our database backups are gone within seven days.
What you're responsible for
- Rights. You need the rights to everything in your projects, such as music (in Sweden, often a STIM license), recordings, images and text.
- People. If people can be heard or seen in your project, you need their consent or another legal basis. Your organization is responsible for that personal data, and we handle it on your behalf, as described under Data processing agreement.
- Places. A location-based experience sends people somewhere. Make sure the route is safe, that you're allowed to use the place, and that you've asked the landowner or municipality when that's needed. Tell listeners about things they should know, like steep paths, darkness or traffic.
- Acceptable use. Don't publish anything illegal, threatening, harassing or misleading. Don't use Skape to spread malware, to get into other teams' projects, or to overload or attack Skape or anyone else.
AI features
- The AI node uses your team's own Anthropic API key. Your use falls under your team's agreement with Anthropic, and you're responsible for what you send.
- AI assistants that you connect to your account act for you, with your access. Check what they do, as you would with a colleague. To disconnect one, open your team's MCP / AI page in the dashboard, choose Manage on the connection, then Disconnect AI. It loses access to every team on that connection at once. Removing Skape in Claude or ChatGPT stops that app from using it. Connect your AI explains how connecting works.
- If you publish content made with AI, such as a synthetic voice, tell your listeners when the law requires it.
Data processing agreement
When your projects contain personal data, such as an interview, a recorded voice or a name, your organization (or you, if you work on your own) is the controller and we're the processor. This section is our data processing agreement with you under Article 28 of the GDPR, and it applies automatically. If your organization needs its own, such as the template from SKR (Sweden's association of municipalities and regions), send it to us and we'll go through it with you. If we both sign one, it replaces this section.
- What we process. The personal data you put in your projects about the people who appear in them, such as interviewees, people whose voices are recorded, people in photos, and your collaborators. We process it only to run Skape for you, for as long as it's in Skape. That means storing and backing it up, showing it to your team, delivering it to listeners and, when you choose to, sending it to the AI node or to an AI assistant you've connected.
- Only on your instructions. These terms and the way you use Skape are your instructions, including which sub-processors handle the data and where. We don't use the data for anything else. If the law ever requires us to, we tell you first, unless the law forbids it. If we think an instruction breaks the law, we tell you.
- Confidentiality. Everyone at Whateverland who can reach the data is bound to keep it confidential.
- Security. We protect the data as described under Security on the page for organizations. We may change those measures, but we don't lower the overall level of protection.
- Sub-processors. Three of the services listed in our privacy policy store or carry the personal data in your projects: Supabase, Fly.io and, for live audio streams, Cloudflare. You allow us to use them as sub-processors. Each one is bound by data protection terms at least as strict as these, and we're responsible to you for what they do. The other services on the list get only what's described there, such as an IP address. We email you at least 30 days before we add or replace a sub-processor, or as soon as we know if we have to switch at short notice. You can object. If we can't solve it together, you can leave, and we refund paid time you haven't used.
- Transfers outside the EU. Project data is stored in Stockholm, Sweden. When a sub-processor handles it from outside the EU, the transfer is covered as listed in our privacy policy: the EU's standard contractual clauses for Supabase, and the EU–US Data Privacy Framework for Fly.io and Cloudflare.
- Helping you. We help you answer requests from the people in your projects. If someone asks to be removed, tell us which files, and we delete them, including files you've already removed from the project. As far as we reasonably can, we also help with security, breach reports, impact assessments and consulting the data protection authority.
- Breaches. If a personal data breach affects your projects, we tell you without undue delay, so you can meet your own 72-hour deadline.
- Audits. We give you the information you need to show that we follow this agreement. We answer your questions and take part in reasonable audits, including inspections by an auditor you choose.
- When it ends. When you delete a project or your account, we delete the personal data in it, and copies in backups are gone within seven days. Export first if you want to keep anything.
Reports and moderation
Anyone can report a project they think is illegal or breaks these terms, with or without an account. See Report a project.
- We confirm that we've received the report, look at it, and tell the person who reported what we decided and how they can challenge the decision.
- A person makes every decision. We don't use automated moderation.
- If we remove or restrict a project, or suspend an account, we tell the team what we did, why, and which rule or law the decision is based on. You can object by replying to that message, and we'll look at the decision again. You can also take the decision to a Swedish court.
- In urgent cases, such as a threat to someone's life or safety, we act right away, without warning you first, and tell you why the same day. If we suspect a crime that puts someone's life or safety at risk, we tell the police.
Our point of contact under the EU Digital Services Act, for users and authorities, is hello@skap.es. Write in Swedish or English.
Availability and support
- We're a small team, and we can't promise that Skape will never be down. If planned work may affect published projects, we tell the affected customers in advance.
- Write to hello@skap.es and we reply within two business days. Enterprise has the response time that's in your agreement.
Leaving
- You can stop using Skape whenever you want. Export any project from the dashboard as a ZIP file: the project's content, screens and logic as JSON, plus its audio, image and video files in their original formats. You can import it into Skape again. Each export says which version of the format it uses, and if you ask, we'll send you a description of the format. The project's description, edit history, team members and account settings aren't included; ask us and we'll send them.
- Leaving is free. When you tell us you're leaving, you have at least 30 days to export before we delete anything, unless you ask us to delete sooner. If you're moving to another service, we help with the move: Skape keeps working for you until it's done, and we tell you about anything we know could get in the way. Then we delete your data as described in the privacy policy, and copies in backups are gone within seven days.
- To delete your account, write to us from its email address. We delete it within 30 days. If you own a team that has other members, we ask them who should take it over before we delete anything. If you're the only member, we delete the team and its projects with your account.
- If you leave during a paid period, we don't refund the rest of the period, except where these terms say so.
If Skape shuts down
If we ever decide to shut Skape down, we'll tell account holders at least 90 days in advance, keep export working until the end, and refund any paid time you haven't used. We can't promise that Skape will exist forever. We can promise that it won't end without warning.
Liability
- We provide Skape with reasonable care and skill.
- We aren't liable for indirect losses, such as lost revenue or profit, or for problems caused by things outside our control, such as a phone's GPS or a mobile network.
- Our total liability is limited to what you've paid us in the 12 months before the claim.
- Nothing here limits liability that can't be limited by law, for example for personal injury, gross negligence or intent.
Suspending or closing an account
We may suspend or close an account that's used in a way that seriously or repeatedly breaks these terms. Except in urgent cases, we warn you first and give you time to export your projects. If we close an account for any other reason, we tell you at least 30 days in advance and why, keep export working until then, and refund paid time you haven't used.
Changes to these terms
If we make significant changes to these terms, we email account holders at least 30 days before the change takes effect and list it at the bottom of this page. If you don't accept a change, you can leave before it takes effect, and we refund paid time you haven't used.
Law and disputes
Swedish law applies. If something goes wrong, we'd rather sort it out by talking. If we can't, disputes are settled by Swedish courts. If you're a consumer living in another EU country, you also keep the protection of your own country's consumer law, and you can take a dispute to a court where you live.
